AMEX: TikTok Bootcamp Event Ad Credit Incentive Official Terms & Conditions (“Terms and Conditions”)
The first 50 eligible TikTok AMEX Partnership attendees that sign up for a newly registered TikTok Ads Manager Account will receive a $100 ad credit incentive once they have (i) newly registered for a TikTok Ads Manager Account and (ii) activated their TikTok Ads Manager Account by spending their first $200 (“Two Hundred Dollar Ad Credit Winners”). PROMOTER: TikTok Information Technologies UK Limited a company registered in England and Wales with company number 10165711 with its registered address at Kaleidoscope, 4 Lindsey Street, London, United Kingdom, EC1A 9HP (“TikTok UK”) and TikTok Technology Limited with company number 635755, a company registered in Ireland, with its registered office at 10 Earlsfort Terrace, Dublin, D02 T380 (“TikTok Ireland”), TikTok UK and TikTok Ireland shall be collectively referred to as the (“Promoter”).
BACKGROUND: The purpose of this promotion is to encourage businesses (that meet the eligibility criteria listed below) to create a ‘TikTok Ads Manager Account’ (“TikTok Ads Manager Account”) and a certain number of eligible entrants will receive an award in advertising credits, provided that each entrant meets the eligibility criteria and complies with these Terms and Conditions (“Promotion”). Promotions are subject to all applicable local advertisement laws.
INCENTIVE PERIOD: [30th November 2023 to 31st January 2024] (“Incentive Period”).
ELIGIBILITY: THIS INCENTIVE IS OPEN ONLY TO: (A) BUSINESSES LOCATED IN THE UK, FRANCE, ITALY, GERMANY, AUSTRIA, SWITZERLAND OR SAUDI ARABIA WHO DO NOT HAVE AN EXISTING TIKTOK AD MANAGER ACCOUNT AT THE START OF THE INCENTIVE PERIOD (THE INDIVIDUAL ENTERING FOR AND ON BEHALF OF THE BUSINESS MUST BE AT LEAST 18 YEARS OLD); (B) ATTENDEES OF THE TIKTOK BOOTCAMP ON 1st NOVEMBER 2023 and 14th NOVEMBER 2023 (“TikTok Bootcamp”); AND (C) BUSINESES THAT HAVE ACCEPTED THESE TERMS AND CONDITIONS BY 14th NOVEMBER 2023. The Promoter may request valid proof of eligibility, including any relevant documentation and/or information. Promoter shall determine, in its sole discretion, whether an entry meets the eligibility criteria to participate in the Promotion including, without limitation, the sufficiency of proof provided. Promoter’s decisions regarding eligibility and all other aspects of the Promotion are final and binding. Employees of Promoter, its parent, subsidiaries, affiliates, promotion and advertising agencies, and members of their immediate family (spouse and parent, children and siblings and their respective spouses, regardless of where they reside) and persons living in the same household, whether or not related, of such employees, are not eligible to enter or win. By participating, each entrant agrees to abide by these Terms and Conditions and decisions of Promoter, which shall be final and binding in all respects relating to the Promotion (and any Prizes) and acknowledges that any violation of these Terms and Conditions may result in disqualification from the Promotion.
ENTRY / PRIZE: The first 50 eligible TikTok AMEX Partnership attendees that sign up for a newly registered TikTok Ads Manager Account will receive a $100 ad credit incentive once they have (i) newly registered for a TikTok Ads Manager Account and (ii) activated their TikTok Ads Manager Account by spending their first $200 (“Two Hundred Dollar Ad Credit Winners”). (“Two Hundred Dollar Ad Credit Winners shall be referred to as the “Winners”). Incentives are limited to one (1) entry per eligible business throughout the entire Incentive Period meaning that a business cannot enter more than once.
The Prize may be used solely for media placement within the TikTok Ads Manager platform ("TTAM"). The Prizes are subject to all applicable TikTok policies, terms listed here https://ads.tiktok.com/i18n/official/article?aid=10016914, agreements, and other requirements necessary for you to access and use the Prize and TTAM (the "Ad Policies"). You hereby agree and acknowledge that you shall adhere to all applicable Ad Policies including, without limitation, participating in TTAM onboarding and creating a TTAM account. You may not transfer the Prize to any third party including, without limitation, your affiliates. The Prize will be distributed to the selected winners via their TTAM account within two to three weeks from the time the winner is notified. The Prizes will expire sixty (60) days from receipt. DRAWING: Winners will be selected by a representative of the Promoter following the TikTok Bootcamp. Winners will be notified by email. If a potential winner does not respond to the initial notification within the time period stated in the email notification, does not return all required documentation within the time period stated, or if a Prize notification or Prize is returned as undeliverable, or such potential winner is not in compliance with these Terms and Conditions , the Prize will be forfeited and, at Promoter’s discretion, an alternate Winner selected.
LIMITATIONS OF LIABILITY: To the maximum extent permitted by law, Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of (i) the Promotion, (ii) any technical difficulties or equipment malfunction (whether or not under Promoter’s control); (iii) any theft, unauthorized access or third party interference within TTAM; (iv) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by Promoter) due to any reason beyond the reasonable control of Promoter; (vi) any tax liability incurred by a Winner or (vii) use of a Prize. Promoter does not exclude or limit in any way our liability to you where it would be unlawful to do so. Promoter cannot exclude our liability: for damages arising out of injury to body or health or death based on any acts or omissions conducted by us or conducted by our legal representative or designated agent; for fraudulent misrepresentation, intent and gross negligence; to the extent we have provided a guarantee (which must be expressly designed as such in order to be a guarantee in the legal sense); for breach of Promoter’s contractual obligations under these Terms and Conditions, except if our breach is due to a force majeure event; or for damages arising from wilful misconduct or gross negligence. In all other cases, Promoter shall only be liable for direct damages up to the amount of the foreseen or typically foreseeable damage. Promoter is not responsible for any event of force majeure (including natural disasters, activities subject to the instructions of government agencies, cyberattacks, pandemic, actions taken by governments, system failure of the Platform (including TTAM) qualifying as ‘force majeure’, actions of third parties (other than our subcontractors), which results in loss, damage or disappointment suffered by you as a result of your participation in the Promotion. Insofar as permitted by law, we will not assume any responsibility or liability for any inaccurate or failed electronic data transmission, technical faults, failed entries nor any inaccessibility or unavailability of the internet or the Platform (including TTAM).
Use of Data: Promoter will be collecting personal data about entrants in accordance with its privacy policy. Personal data provided by entrants will only be used and processed by the Promoter for the purposes of conducting the Promotion, on the basis that it has a legitimate interest in managing and administering the Promotion, ensuring that the Promotion is run fairly and contacting the Prize winners, if the information requested is not provided, the entrant may not be able to participate in the Promotion. Governing Law and Jurisdiction: These Terms and Conditions will be governed by the laws of England and Wales and any disputes will be subject to the exclusive jurisdiction of the English courts. However, this clause shall not deprive you from benefiting from the mandatory provisions of the law of your country of residence or from bringing any action in front of the competent courts of your country of residence.
